Latin is where it comes, etymologically speaking, the term that now concerns us. More exactly we find the fact that that emanates from the verb I will subornare which was the result of the sum of the suffix sub-, which can be translated as "below", and the verb decorate, which is equivalent to "equip". In this way, it is concluded that I will subornare It was synonymous with "providing in secret."
Bribery is the gift with which he bribes and the action and effect of bribing. This verb, originating in the Latin subornāre, refers to corrupt someone with money, gifts or some favor to get some of this person .
Bribery is also known as bribery or, in the colloquial language, coima . It is a crime when a public official accepts or demands a gift to specify an action or omit it.
It is possible to distinguish between a simple bribe (when the official accepts money to comply with an act) and a qualified bribery (when the gift is delivered to hinder or prevent the performance of an action). The person offering or accepting the gift incurs the crime of passive bribery .
An example of bribery takes place when an employer pays a gift to a public official with the aim of favoring him in a tender or contest. On the other hand, an entrepreneur can bribe an inspector so that an investigation does not yield negative results.
In the same way we can establish that we can also classify bribes based on the area where they are developed. Thus, on the one hand, we have bribes in the public sphere that are those in which a figure of the public administration takes center stage. A clear example of this is when any individual is stopped on the road by the police for speeding and he offers money to the authority as long as he does not pay the corresponding fine.
On the other hand, there are bribes in the sphere of the private or private sphere. They are the ones that give between individuals when one of them offers money to another as long as he undertakes or not some kind of action that can favor the former. A clear example of this is when a citizen who works in a company takes the money offered by another so that he does not hire a third party.
It is important to emphasize that until recently in Spain this bribe between individuals is not criminalized. However, the legislation changed in 2009 and now it is considered as such.
Bribes also exist outside the state level. It is possible for a seller to bribe the person in charge of purchasing a company to which you are trying to sell a product or service, with the intention of choosing your proposal over that of the competitors.
Beyond the fact that bribery involves a crime, the fact of corrupting someone for personal gain implies a lack of ethics which, in this sense, should be avoided without the need for legal punishment.
